Gay & Lesbian Immigration

At The Shulman Law Group , we have had the opportunity to help gay and lesbian people obtain visas, green cards, labor certifications, withholding of removal and political asylum. There are a number of issues that are unique to the GLBT community in terms of immigration and our lawyers have experience making the existing immigration laws work for our gay and lesbian clients and their partners.

Some common questions or concerns include:

  • How do I bring my gay / lesbian partner to the U.S.?
  • Is a person's immigration status treated differently after a sex change?
  • Is persecution for being gay cause for asylum?
  • Who counts as a "family" member?
  • Is it more difficult to obtain a green card?

New Laws

New laws are continually affecting immigration law, and our responsibility as immigration lawyers is to remain current with all existing and pending legislation, rules, and regulations. One of these proposed laws is the UAFA, Uniting American Families Act, previously known as the Permanent Partners Immigration Act(PPIA). UAFA (H.R.3006) would add the term "permanent partner" to the federal law's list of definitions of family, and all same-sex partners of U.S. citizens and lawful permanent residents to remain in the country. Although this is not law, our attorneys maintain an awareness of any pending legislation, as well as existing laws affecting our immigration clientele.

For some clients, it is reassuring to have practice that is gay friendly, and in those instances, Daniel Weiss is not only eminently qualified, but also has a personal commitment to gay and lesbian immigration issues.

If you need a visa, wish to immigrate, or want to help bring a family member or employee to the United States, we can help. If you are facing deportation or removal for any reason, you need our help. You may contact our offices for more information or to schedule an appointment. Please fill out the immigration questionnaire and bring it with you for your initial consultation with our immigration lawyers.
